Retailers who are in the business of selling used video games could find their doors shuttered in the future, thanks to a Court of Appeals ruling stating that software companies may prohibit customers from reselling products. The case involved an individual who attempted to sell copies of AutoCAD on eBay after acquiring them at an office sale. According to the program’s End User License Agreement (EULA), the product is simply licensed and not actually sold to customers, and is therefore non-transferable.

AjPitts: If this law passes, it will only further incentivize pirating these games.  Believe me, this is something we do not want to happen.  Widespread pirating makes it almost impossible for companies to justify spending the millions of dollars it takes to produce a high budget game.  They will likely turn to more profitable ventures like Farmville (a case study in the Idiocracy thesis…) because it is immune to piracy.  The gaming industry is focusing on the wrong thing entirely here…

All in all, it’s bad for hardcore gamers and the future of hardcore titles. (in my opinion)
